Luigi Mangione's lawyer files motion to dismiss criminal charges including the one for which he could face the death penalty

There has been a new development in Luigi Mangione’s case. According to a report by The Associated Press from October 11, his legal representatives had requested a judge to let go of some of his criminal charges. This also includes the offense for which he could receive a death penalty. Mangione faces a federal indictment for allegedly shooting the CEO of UnitedHealthcare, Brian Thompson.

He has pleaded not guilty to the charges. As per the court documents, Mangione’s legal team requested that the prosecutors be prevented from using his statements that he provided to the officers. According to them, he did not read his rights before the statements were recorded. Furthermore, the officers were not in possession of a search warrant before they went through his backpack, from which weapons were recovered.

The request was submitted by Luigi Mangione’s lawyer, Karen Friedman Agnifilo. As seen in an X post by Inner City Press, the docket text mentions:

“MOTION to Dismiss Counts Three and Four and to Suppress Evidence and Statements. Document filed by Luigi Nicholas Mangione.”

According to NBC News, the decision to file a motion for dismissal of the death penalty came after the Justice Department rejected the accusation that two of its employees jeopardized the trial. His lawyers claimed that repeated attempts to violate the court orders could have an impact on the potential jurors.

Per CBS New York, a social media account for the White House posted a clip in which President Donald Trump said:

“Mangione shot someone in the back as clear as you are looking at me.”

Two officials from the Department of Justice reposted the video clip, and one of them allegedly captioned the post:

“POTUS is absolutely right.”

Luigi Mangione accused the prosecutors of inappropriately accessing his personal medical records

In August 2025, prosecutors at the Manhattan District Attorney’s office were under fire after Luigi Mangione claimed that they had intentionally violated his rights by going through his personal medical records. At the time, the defense said:

“Prosecutors could see medical diagnoses and statements made by Mr. Mangione to healthcare providers.”

However, the prosecutors had denied these claims. They said they had followed due legal processes to access the information from Mangione’s insurance provider. They blamed the insurance provider for sharing more details than required. Upon realizing this, the prosecutors notified the court, and the information and material related to the excess were gotten rid of. Luigi Mangione’s defense requested a hearing for the matter, requesting:

“an appropriate remedy commensurate with the gravity of the violation.”

According to the defense team, the action in this regard could be dismissal of charges, removing the assigned prosecutors, or suppressing the evidence.

While being in jail, Luigi Mangione still received a lot of mail. The letters that he opened in July were the ones that were sent to him in January 2025.
