Businesspersons Andrew Tate and his brother Tristan Tate are facing an investigation by the United States District Court for the Southern District of New York. However, according to their lawyer, Joseph McBride, this probe is a formality.
According to an exclusive report by TMZ, McBride stated that he had a conversation with Assistant United States Attorney Jacqueline Kelly concerning the investigation. He inquired if Andrew and Tristan Tate needed to come in for questioning, to which Kelly replied they did not need to.
McBride claimed he would send Kelly why the investigation must be dropped. However, Kelly said that would not be needed on his part. Quoted by TMZ, he said:
“We respectfully assert that the lack of an indictment, along with the absence of any requirement to appear for questioning or any request for a statement, indicates that the SDNY's investigation is merely a formality.”
The investigation concerns the $5 million defamation lawsuit the Tate brothers filed in 2023. The suit was against an unnamed woman and three other people. In this lawsuit, the Tates claimed that the defendants' accusations caused officials in Romania to file criminal charges against the brothers.
The defendants filed a civil lawsuit in Palm Beach County, Florida, aiming to put a halt to the defamation lawsuit. According to the New York Post, attorney Danielle Pinter argued that documentation about the investigation should not be made public. She stated this should be the case until the federal investigation against Andrew Tate is completed.
Lawyer Matthew Jury shared an update on the civil action suit against Andrew Tate
Joseph McBride reportedly claimed the lawyers involved in the defamation case were trying to delay things because they were afraid to face the evidence supporting his side. According to the Daily Mail, lawyer Matthew Jury shared an update about the civil action suit on April 5, 2025. Taking to his X, Jury wrote:
“Andrew and Tristan Tate’s civil action in Florida against one of their alleged trafficking victims has been stayed at the request of the US authorities. Why? Because the Tates are now the subject of a Federal investigation and/ or prosecution by the DOJ for the Southern District of New York.”
He explained that the situation differed from the previous criminal investigation into Tristan and Andrew Tate in Florida. He added that the Tates were being investigated for criminal matters in five places - Romania, the UK, Florida, California, and the United States. However, he later shared a correction, writing:
“The case has not yet been stayed but a motion to stay it has been filed for the reasons detailed above and is pending adjudication by the court.”
This comes at a time when Andrew Tate’s partner, Brianna 'Bri' Stern, filed a case against him for alleged abuse. She said that during their stay at the Beverly Hills Hotel on March 11, he allegedly choked her until she nearly passed out. Stern also claimed he sent her violent and threatening messages.
According to her, the relationship started out caring but grew increasingly abusive over ten months, eventually ending in a violent incident at the hotel. She managed to run away in the early morning after Andrew Tate allegedly shouted at her.
